“The key argument we made is you can’t resolve issues like this in court,” Boutrous said. “You can’t resolve these sorts of global issues in one case.”

In similar cases, judges have tended to agree that the court is not the proper place to decide on “public nuisance” lawsuits related to climate change. Chevron on Tuesday filed a motion to dismiss the lawsuit; Alsup is expected to rule on that motion next month....

Looking around various links - I saw a protest sign that read: `Facts Denied Are Still Facts`. I suspect that while the judge dismissed that portion from this lawsuit, that it will eventually be taken up - maybe in a slightly different form, in another lawsuit.

What is better - is that it wasn`t even tried - but rather this portion of the lawsuit was dismissed on the basis of what amount to opening arguments - a pretrial presentation. No doubt it will be before a court again.
