Here's the bottom line, folks.

According to the Legal Agreement we are required to follow from the domain registrar, in this case GoDaddy, it is a violation of their terms of service to permit

Morally objectionable activities will include, but not be limited to: activities designed to defame, embarrass, harm, abuse, threaten, slander or harass third parties; activities prohibited by the laws of the United States and/or foreign territories in which You conduct business; activities designed to encourage unlawful behavior by others, such as hate crimes, terrorism and child pornography; activities that are tortious, vulgar, obscene, invasive of the privacy of a third party, racially, ethnically, or otherwise objectionable; activities designed to impersonate the identity of a third party; and activities designed to harm or use unethically minors in any way. ... eid=REG_SA
Hateful content such as the example given in the opening post of this topic--and there are more vehement examples on this forum--clearly qualifies as "racially, ethnically" objectionable, and can be construed as abusive at the very least.

As far as I'm concerned, this is a legal issue and I cannot compromise on that. The domain does not belong to me; use of that resource and others have been entrusted to me and I am obliged to see that they are used responsibly. I cannot risk the loss of someone else's property, in this case the domain registration, which is not mine to risk.

Given Michael Shermer's writing on the subject of The Holocaust, discussions of that topic are valid and permissible and will be allowed to continue. Attacks on any group of people as a racial or ethnic group will not be permitted or allowed to continue. Thus, if you want to question the validity of history regarding the Holocaust, fine. If you want to defame Jews or any other ethnic or racial group, you'll have to do that somewhere else.

As I do not agree with retroactive punishment when a new rule is put in force, I won't ban anyone for past defamation. I do officially put you on notice that hateful content is no longer permissible.

My apologies for any mixed messages or misunderstanding I may have conveyed in the discussion of this issue and in my recent announcement, and for failing to fully consider all the issues involved. The legal agreement with the domain registrar is no small matter and cannot be ignored.

This supersedes my previous announcement on this issue. Except for the wording of the proposed rule, this decision is final and non-negotiable.

Proposed rules change:

Posts and/or topics that contain defamatory, dehumanizing content directed at ethnic or racial groups will either be locked or removed. Persons posting defamatory, dehumanizing content directed at ethnic groups, racial groups, gender, hetero- or homosexuality will be warned on the first offense. Offenses after the first warning may result in temporary or permanent banning from this forum.

This will not apply to criticisms of beliefs, ideologies, philosophies, claims of fact, scientific hypotheses, paranormal claims, or political opinions.
